If you or your loved one has been arrested for aggravated assault with deadly weapon, you want to  secure bail as fast as possible to allow you to reunite with your family and prepare for your court appearance.

What is Aggravated Assault with Deadly Weapon?

According to the Texas Penal Code, aggravated assault with deadly weapons occurs when a person uses a deadly weapon to commit an assault, which results in serious bodily injury.

Contrary to what you might think, deadly weapons here are not restricted to firearms or knives. A deadly weapon is any object that can cause death or serious bodily injuries, such as clubs, baseball bats, iron knuckles, blackjack, and daggers.

In other words, a person commits aggravated assault with deadly weapon when they assault (or threatens to assault) another person, using a deadly weapon.

What is the Punishment for Aggravated Assault with a Deadly Weapon?

Aggravated assault with a deadly weapon is a felony and is punishable by a jail term of up to 20 years.  Typically, it is considered a second-degree felony and is punishable by a jail term of 2 to 20 years, with a fine of up to $10,000.

However, according to the Texas Penal Code, aggravated assault with a deadly weapon can be a first degree felony under the following conditions:

  1. If the assault is committed against a spouse, a former spouse, an intimate partner, or any other family member.
  2. The assault is committed against a public servant while they are carrying out their official duties.
  3. A person recklessly discharges firearms from a motor vehicle towards a home, business, or another vehicle and causes serious bodily injury to other people.

As a first-degree felony, aggravated assault with bodily injury is punishable by a minimum of 5 years imprisonment and up to 99 years in jail.

Can You Get Bail for Aggravated Assault with a Deadly Weapon?
